Agreement
By creating an account, purchasing a subscription, downloading or activating FortisRestore, or using the service, you agree to these Terms. If you use FortisRestore for an organization, you represent that you have authority to bind it.
1. The service
FortisRestore, operated by Munklunk, LLC, provides backup, restore, migration, scheduling, remote-storage integration, licensing, software updates, and related tools for supported Joomla and WordPress websites. Features vary by platform, plan, software version, hosting environment, and connected provider.
You remain responsible for your websites, hosting, data, credentials, recovery keys, connected storage accounts, legal compliance, and verifying that a usable backup exists before modifying or deleting production data.
2. Accounts and security
You must provide accurate information and protect your account credentials, license keys, encryption or recovery keys, and administrator access. Notify us promptly at support@fortisrestore.app if you suspect unauthorized access. You are responsible for activity performed through your account unless prohibited by law.
3. Plans and licenses
The Free plan includes only the features displayed as available without a paid license. Paid features require an active subscription. A Pro license may be activated only on the number of sites stated at purchase. An Agency license may be used on sites you own or manage for clients, subject to any limits displayed at purchase.
License keys may not be resold, shared publicly, sublicensed, or used to provide unauthorized copies of FortisRestore. We may restrict or deactivate licenses used fraudulently, beyond their stated allowance, or in material violation of these Terms.
4. Subscriptions, billing, and cancellation
Paid subscriptions are billed in advance through Stripe at the price and interval shown at checkout. Subscriptions renew automatically until canceled. You authorize Stripe and FortisRestore to charge the payment method associated with your subscription for recurring fees and applicable taxes.
You may update payment details, switch eligible plans, view invoices, or cancel through your FortisRestore account. Cancellation takes effect at the end of the current paid billing period unless Stripe or applicable law states otherwise. Fees already paid are non-refundable except where required by law or expressly agreed by us. Prices or plan features may change prospectively; we will provide notice when required.
5. Backups and connected services
FortisRestore can create archives locally or transfer them to storage providers you connect. Those providers operate under their own terms and privacy policies. We do not control their availability, retention, permissions, or account restrictions.
No backup system eliminates all risk. You must retain independent copies, keep sufficient storage available, safeguard encryption keys, monitor job results, and regularly test restores. Never treat an unverified archive or a single storage location as your only recovery plan.
6. Acceptable use
You may not use the service to violate law; infringe rights; distribute malware; gain unauthorized access; disrupt infrastructure; bypass license, security, or usage controls; reverse engineer protected service components except where law permits; or back up, restore, or migrate a site without authorization.
7. Software and intellectual property
FortisRestore and its branding, hosted services, documentation, and proprietary components are owned by Munklunk, LLC or its licensors. Any open-source components are governed by their stated licenses. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use FortisRestore for its intended purpose during the applicable license term.
8. Availability, updates, and support
We may improve, secure, update, suspend, or discontinue parts of the service. Hosting environments and third-party APIs can change without notice, and compatibility is limited to the published system requirements. Support is provided through the channels and service level associated with your plan.
9. Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free recovery. We do not guarantee that every file, database, configuration, provider, or environment can be backed up or restored successfully.
10. Limitation of liability
To the maximum extent permitted by law, Munklunk, LLC and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, revenue, profits, goodwill, or business interruption. Our aggregate liability arising from the service will not exceed the amount you paid for FortisRestore during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.
11. Suspension and termination
You may stop using FortisRestore at any time. We may suspend or terminate access for nonpayment, fraud, security risk, unlawful activity, material breach, or harm to the service or others. Provisions that by their nature should survive termination—including payment obligations, ownership, disclaimers, liability limits, and dispute provisions—will survive.
12. Changes and contact
We may update these Terms as the service evolves. Material changes will be posted here with a revised effective date and communicated when legally required. Continued use after an update takes effect constitutes acceptance where permitted by law.
